Commitment to privacy

QEM Limited (“QEM”, the “Company”) is committed to protecting and safeguarding privacy and to ensuring that all personal information the Company receives is handled in accordance with the requirements of the Privacy Act 1988 (Cth) (Act), which regulates the way organisations collect, use, hold and disclose personal information.

Collection of Information

When used in this Policy, the term ‘personal information’ has the meaning given to it in the Act. In general terms it is any information that can personally identify an individual. Information which cannot be reasonably linked to your identity (e.g. IP address, browser information, favourite websites or the number of users of a website) does not constitute personal information and is not regulated by the Act.

QEM may collect personal information about an individual in a variety of ways, including when an individual interacts with QEM in person or electronically, for example when individuals access our website.

By using the Company’s website and services an individual consents to the Company using their personal information and other data as set out in this Policy.

QEM will only collect personal information about an individual where the information is reasonably necessary for one or more of our functions or activities. The kinds of personal information collected and held, how that information is collected and held and the purposes for which that information will be collected, held, used and disclosed will depend on the circumstances.

Examples of instances where personal information may be collected by QEM include:

  1. collecting personal information from shareholders for the purposes of enabling proper records to be kept and for reporting purposes; and
  2. collecting personal information from individuals who enter into service agreements, joint venture agreements or other transactions with the Company for the purpose of administering those agreements or transactions or for reporting purposes.

Examples of the kinds of personal information QEM may collect and hold include:

  2. address;
  3. phone number;
  4. age or date of birth;
  5. gender of an individual;
  6. fax number;
  7. email address;
  8. information about goods or services ordered, acquired or supplied;
  9. information from enquiries made;
  10. communications between QEM and an individual; and
  11. credit card information.

QEM will take reasonable steps to ensure that the personal information that is collected, used or disclosed by it is complete and up to date. The Company will only collect personal information about an individual from that individual unless it is unreasonable or impractical to do so.

Personal information will not be shared, sold, rented or disclosed other than as described in this Policy or as permitted under the Act.

Use and disclosure of information

At or before, or if that is not practicable, as soon as practicable after, the time that the personal information is collected, QEM will take reasonable steps to ensure that the individual is aware of the matters required by the Australian Privacy Principles, including:

  1. why the personal information is being collected;
  2. who else the personal information might be given to;
  3. the fact that this Privacy Policy contains information about how the individual is able to gain access to and correction of the information collected; and
  4. how to contact QEM, including to make a complaint.

If QEM collects personal information about an individual from someone else, the Company will take reasonable steps to ensure that the individual is aware that the Company has collected the information and of the above matters.

QEM will only use or disclose this personal information for:

  1. the purpose for which it was collected;
  2. any related purpose for which it would reasonably be expected to be used or disclosed;
  3. a purpose required or permitted by law; or
  4. a purpose for which the individual has provided consent.

Examples of instances where QEM may disclose personal information about individuals to third parties include disclosure to providers of services to the Company, government agencies, regulatory authorities, related bodies corporate of QEM and professional advisers of QEM. The Company requires its service providers to keep the personal information confidential and not use it for any purpose other than performing those services.

QEM is unlikely to disclose personal information to overseas recipients.

Updating Personal Information

At the request of an individual, QEM will, in most circumstances, provide access to an individual to any personal information that is being held by the Company about that individual.

There are certain circumstances where QEM will not provide an individual access to such personal information in accordance with the Act. These circumstances include where providing access would have an unreasonable impact on the privacy of others, where providing access would reveal commercially sensitive information about the organisation or where providing access would be unlawful.

An individual can seek access to, and update or correct, any personal information that is being held by QEM about that individual by contacting us through the Contact Page We may charge you a fee to cover our administrative and other reasonable costs in providing the information to you and, if so, the fees will be advised from time to time. We will not charge for simply making the request and will not charge for making any corrections to your personal information.

Personal Information Security

QEM takes reasonable steps to ensure personal information is protected from misuse and loss from unauthorised access, modification or disclosure. Personal information and other data may be stored in hard copy documents, but is generally stored electronically on our software or systems or on those of our third-party service providers. Personal information is destroyed or de-identified when no longer needed.

As our website is linked to the internet, and the internet is essentially insecure, the Company cannot provide any assurance regarding the security of transmission of information that is communicated to the Company online. The Company also cannot guarantee that the information supplied will not be intercepted while being transmitted over the internet. Accordingly, any personal information or other information which transmitted to the Company online is transmitted at the individuals own risk.

Additionally, individuals using our website and services acknowledge that the collection and use of personal information by third-parties may be subject to separate privacy policies and/or the laws of other jurisdictions.

The Company makes no representations or warranties in relation to the privacy practices of any third-party website and is not responsible for the privacy policies or content of any third-party websites. Third-party websites are responsible for informing individuals about their own practices.

Amendment of Policy

QEM may amend this Policy from time to time.

Intranet and Website

This Policy as amended from time to time is to be placed on the QEM intranet and website and is also available upon request.

Concerns, Queries and Complaints

If a person has any concern, query or complaint about: any personal information that may have been collected, used or disclosed by QEM, this Privacy Policy, or a breach of the Australian Privacy Principles, they are to be referred to the Company Secretary/Chief Financial Officer to the address in the footer of this website. QEM takes complaints very seriously and will respond shortly after receiving written notice of the complaint. QEM will treat your complaints confidentially.
